How to Publish on the Apple App Store as a US LLC From Outside the US (2026 Guide)

You do not have an App Store nationality problem. You have a US LLC, a build that compiles, and an organisation enrollment that stalls on identity. Here is the non-resident path for publishing on the Apple App Store through a US LLC in 2026.

Foreign founders enroll as individuals, ship under a personal seller name, then try to “upgrade” into a company later while TestFlight burns. Or they enroll the LLC with a Gmail address, a parked domain, and a D-U-N-S Number that still says “pending.” The slogan becomes “Apple blocks non-residents.”

That is the wrong wall. Apple’s organisation path is a verification path: legal entity, D-U-N-S, work email on your domain, public website, and a human with authority to bind the company. Your passport can sit abroad. The pack still has to match.

At OtoCo we help non-residents form and maintain US LLCs in Wyoming and Delaware. We do not sell Apple enrollment and we do not guarantee Apple approval. This guide is educational only. It is not legal advice. Tax treatment is a separate question; talk to a qualified tax professional.

Short answer: To enroll a US LLC as an organisation in the Apple Developer Program you need a legal entity Apple can contract with (not a DBA), a D-U-N-S Number, a work email on the organisation’s domain, a publicly available functional website on that domain story, and an Account Holder with legal authority to bind the company. Membership is 99 USD per membership year (prices may vary by region). Individual enrollment is a different path with a personal seller name. Get the D-U-N-S Number first, then enroll. OtoCo forms the company layer; Apple decides enrollment.

Organisation versus individual enrollment

Apple lets you enroll as an individual or as an organisation.

Individual. Your personal legal name becomes the seller name. Apple confirms legal name, email, phone, and address (P.O. boxes not accepted). This path is simpler and wrong if you already decided the LLC should be the merchant and contracting party.

Organisation. The company’s legal entity name becomes the seller name on the App Store. Apple explicitly says it does not accept DBAs, fictitious business names, trade names, or branches as the organisation name. The LLC’s formation name is the string that matters.

If the product is owned by the LLC, banked by the LLC, and invoiced by the LLC, enrol the organisation. Do not build three years of reviews under your personal name and hope for a clean migration story later.

What Apple confirms for organisations

From Apple’s current enroll page, organisation enrollment checks:

  1. Legal binding authority. You become the Account Holder. You must be an owner/founder, executive team member, senior project lead, or an employee with legal authority granted by a senior employee. Bring the authority story that matches your operating agreement.
  2. Legal entity name and status. A legal entity that can enter contracts with Apple. Again: no DBA-as-organisation-name.
  3. D-U-N-S Number. Required for organisations other than excluded government entities so Apple can verify identity, legal entity status, and address. Request it from Dun & Bradstreet before you expect Apple’s lookup to succeed. Companion guide: how to get a D-U-N-S Number for your US LLC.
  4. Phone and email. Work email must be associated with your organisation’s domain name.
  5. Website. Publicly available and functional. Domain associated with the organisation. Apple rejects social-only pages and thin registrar parking pages.

You also need an Apple Account with two-factor authentication. Apple recommends that account use your organisation email, with your real first and last legal names (no nicknames).

Membership fee

After verification, you agree to the Apple Developer Program License Agreement and complete membership purchase. Apple states the Apple Developer Program is 99 USD per membership year, with regional currency variation during enrollment. Nonprofits, accredited educational institutions, and government entities may request a fee waiver if they meet Apple’s requirements.

Sequence that works from abroad

  1. Form the US LLC and sign an operating agreement that makes signing authority obvious.
  2. Buy and build a real domain on the company brand. Publish a site that explains the product in plain language.
  3. Create work email on that domain for the Account Holder.
  4. Request the D-U-N-S Number with the exact legal name and a consistent address. Wait until Dun & Bradstreet finishes; normal D&B timing can run up to 30 business days unless you use their expedite product.
  5. Start organisation enrollment in the Apple Developer flow with two-factor auth on.
  6. Answer verification with formation documents and authority evidence if Apple asks.
  7. Pay the membership, then complete App Store Connect setup, agreements, banking, and paid apps contracts as Apple presents them.
  8. Ship. App Review is a separate gate from enrollment.

Remote founders lose weeks on steps 2 to 4 while pretending the blocker is “foreign founder.” Fix the domain and D-U-N-S first.

Documents and identity hygiene

Keep a folder:

  • Certificate of Formation or Articles of Organization
  • Operating agreement / ownership schedule
  • Government ID for the Account Holder
  • D-U-N-S confirmation
  • Screenshots of the live website and DNS email setup

Use the same legal name string everywhere. “Acme LLC” versus “Acme, LLC” versus “Acme Apps” is how enrollment tickets are born.

What OtoCo is and is not in this flow

OtoCo can form Delaware or Wyoming LLCs (Instant Series from $99/year, Standalone from $299/year on public pricing), keep registered agent cover, and help you hold a coherent document pack. We are not Apple. We do not promise enrollment timing. We do not provide a fake HQ so you can skip domicile realities on other platforms.

If you still need a US operational mailing address for banking and processors, that is a parallel track to Apple’s website and email requirements. Companion: virtual business address guide.

FAQ

Can a non-resident be the Account Holder for a US LLC organisation?

Apple’s enroll page focuses on authority and identity verification, not a blanket ban on foreign passports. You must have authority to bind the organisation and complete Apple’s identity checks. Approval remains Apple’s decision.

Do I need a D-U-N-S Number for individual enrollment?

Apple’s organisation checklist calls for D-U-N-S. Individual enrollment follows the personal path instead. If the LLC is the seller, plan on D-U-N-S.

Can I enroll with a Gmail address?

For organisations, Apple wants a work email associated with the organisation’s domain. Personal webmail is the wrong shape.

Is the fee still $99?

Apple’s enroll page states 99 USD per membership year as of our 2026-10-28 check, with regional currency variation. Re-read Apple’s page when you pay.

Closing

App Store organisation enrollment is a company identity exam. Legal entity, D-U-N-S, domain email, real website, and signing authority. Build that pack once, then ship software instead of rewriting seller names.
