You do not have a logo problem. You have a Wyoming or Delaware LLC whose legal name cleared the state database, and you assumed that meant nationwide brand rights. Here is the non-resident path for trademarking a US LLC brand in 2026.

Foreign founders mix three different name systems: the state entity name, a trade name or DBA, and a federal trademark on the USPTO register. The slogan becomes “I already registered the company, so the brand is mine.”

That is the wrong wall. State formation only stops another entity in that state from taking a confusingly similar legal name on the corporate register. It does not give you nationwide priority against every app, Shopify store, or Twitter clone using your mark. Federal trademark practice also forces a domicile address and, for foreign-domiciled applicants, a US-licensed attorney.

At OtoCo we help non-residents form and maintain US LLCs in Wyoming and Delaware. We do not file trademarks as a product and we are not a law firm. This guide is educational only. It is not legal advice. Tax treatment is a separate question; talk to a qualified tax professional.

> **Short answer:** An LLC name is not a trademark. To seek US federal registration you file with the United States Patent and Trademark Office. As of the 2025 fee changes, the base application fee is $350 per class for Sections 1 and 44 filings, with possible surcharges for incomplete information or free-form goods wording. Every applicant must provide a domicile address. Foreign-domiciled applicants and registrants must be represented by a US-licensed attorney under the USPTO’s foreign-attorney rule (see 37 CFR 2.11). Virtual offices, CMRAs, registered-agent streets, and similar mail-drop styles are generally unacceptable as domicile even if they work as mailing addresses. OtoCo builds the company. Trademark counsel files the mark.

## LLC name, DBA, trademark: keep the machines separate

**State LLC name.** Distinguishes your entity on the Delaware or Wyoming register. Banks and Stripe care that this string matches your formation certificate.

**DBA / trade name.** Lets you present a brand that is not the legal entity string in places that recognise trade-name filings. It is not a federal exclusive right and not a liability shield.

**Federal trademark.** A registration on the USPTO’s Principal or Supplemental Register that can support nationwide priority for specific goods and services, subject to use, maintenance, and challenge rules.

You can (and often should) align all three so customers see one brand. You cannot collapse them into one filing.

## The foreign-domiciled attorney rule

The USPTO explains that all applicants and registrants must provide and keep current a domicile address so the Office can tell who the filer is and whether a US-licensed attorney is required. Foreign-domiciled trademark applicants, registrants, and parties to Trademark Trial and Appeal Board proceedings must file through an attorney licensed to practice law in the United States. Canadian applicants are included in that foreign-domiciled requirement for new trademark matters.

Plain English: if the applicant’s domicile sits outside the United States and its territories, you do not TEAS yourself from a cafe in Lisbon and hope. You hire US trademark counsel who appears on the application with bar details.

Even US-domiciled applicants often hire counsel because classification, specimens, and office actions are easy to mishandle. For non-residents the attorney is not optional under the foreign-domiciled rule.

## What “domicile” means when your LLC uses a virtual address

This is the sharp edge for OtoCo-style stacks that use a registered agent plus a virtual mailbox.

USPTO materials distinguish mailing address from domicile address. Domicile for a natural person is where the person resides and intends their principal home. For a juristic entity (your LLC), domicile is the headquarters where senior executives ordinarily direct and control the entity’s activities.

The Trademark Manual of Examining Procedure guidance on domicile acceptability treats post-office boxes, “care of” addresses, commercial mail receiving agency addresses, registered agent addresses, private mailboxes, and similar mail-forwarding styles as presumptively unacceptable as domicile. Virtual office and shared workspace addresses can be mailing addresses but generally may not serve as domicile because they do not identify the real headquarters or home.

So: your Delaware registered agent street is for service of process. Your virtual mailbox is for operational mail. Neither is a shortcut “US domicile” for trademark purposes just because it prints as a street. If the LLC’s real headquarters decision-making sits abroad, expect foreign-domiciled treatment and US counsel. Do not cosplay a US HQ on a USPTO form with a mail-drop.

## Fees you can quote in 2026

Effective 18 January 2025, the USPTO replaced the old TEAS Plus / TEAS Standard split with a single base application fee for Sections 1 and 44: **$350 per class**. Additional fees can apply, including an insufficient-information surcharge and fees when you use free-form goods and services text instead of the Trademark ID Manual. Always re-check the USPTO fee schedule before you pay; schedules move.

Attorney fees are separate and usually dwarf the government fee if you want the application done cleanly.

## A practical non-resident sequence

1. **Search before you fall in love with the logo.** Check the USPTO’s trademark search tools, app stores, domains, and social handles. State LLC name clearance is not enough.
2. **Decide the owner.** Usually the LLC owns the mark so the brand sits inside the company you bank and invoice through.
3. **Write goods and services narrowly and honestly.** Overbroad classes invite trouble. Prefer ID Manual wording when you can.
4. **Hire US trademark counsel if you are foreign-domiciled.** Budget for their review of domicile, ownership, and specimens.
5. **File through Trademark Center with a complete base application.** Incomplete packs trigger surcharges and delays.
6. **Plan for office actions, publication, and maintenance.** Registration is a process, not a checkout button.
7. **Keep brand use consistent** on the website, App Store seller name, and contracts once you claim use in commerce.

## How this fits an OtoCo company pack

OtoCo can put the LLC on the map, keep registered agent cover, and help you hold documents banks recognise. Trademark filing is counsel’s lane. What we care about for founders is consistency: the legal name on formation, the brand on the storefront, and the owner named on the trademark application should tell one story.

If you are still choosing a name before formation, run the entity search and a rough trademark screen in the same week. Renaming later is messier than picking a clear string once.

## FAQ

### Does registering my LLC trademark my name automatically?

No. State formation is not a USPTO registration.

### Can I file without a US attorney if my LLC is Delaware or Wyoming?

Entity formation state is not the same as domicile. If the applicant is foreign-domiciled, the USPTO requires a US-licensed attorney regardless of where the LLC was formed.

### Can I list my virtual mailbox as the domicile address?

Generally no for domicile. USPTO guidance treats virtual offices, CMRAs, registered-agent addresses, and similar mail-drop styles as unacceptable domicile addresses even when they work for mail.

### How much is the government filing fee?

The base application fee is $350 per class under the post-January 2025 schedule for Sections 1 and 44, before surcharges and before attorney fees. Confirm on the USPTO fee schedule when you file.

## Closing

Treat trademarks as their own system. Form the LLC for banking and contracts, then file the mark with eyes open on domicile and the foreign-attorney rule. A virtual address helps you receive mail. It does not invent a US headquarters for the USPTO.
